May 8, 2023
NOTICE OF ELECTION FOR CERTIFICATION OF EXCLUSIVE BARGAINING REPRESENTATIVE
Pursuant to the Falls Church City Public Schools Collective Bargaining Resolution, the Falls Church City Education Association (“FCCEA”) is seeking certification as the Exclusive Representative of employees in the Non-Certified Bargaining Unit. This bargaining unit consists of:
Employees who are not required to have a professional license from the Virginia Board of Education or Virginia Board of Health to qualify for their current FCCPS position (e.g., paraprofessional, administrative assistant, custodian, bus driver), including both full-time and part-time permanent employees. Employees in this Bargaining Unit will vote online in a secret ballot election to determine if they wish to be represented by the FCCEA for purposes of collective bargaining.
As a member of this Bargaining Unit, you are eligible to vote in this election. The representation election for the Non-Certified Bargaining Unit is being conducted online by secret ballot through the BallotPoint Election Services voting system. Votes may be cast between 6 a.m. on Monday, May 22, 2023, and 5 p.m. on Tuesday, May 23, 2023. Voter credentials and voting instructions will be sent to eligible voters via email to their FCCPS email address. All eligible staff members are encouraged to vote so their voice can be heard. The determination of whether staff will or will not be represented by FCCEA for the purposes of collective bargaining will be determined by the majority of those who vote.
Other Employee Organizations have an opportunity to be included in this election by filing a request to intervene within 7 days of this Notice, or no later than the close of business on Monday, May 15, 2023. Other employee Organizations may intervene by filing a request for election with the Clerk of the School Board at gadellm@fccps.org. The request to intervene shall include (1) the Employee Organization’s name and address, (2) the Bargaining Unit(s) it seeks to represent, (3) a statement certifying that at least thirty percent (30%) of the Employees in the Bargaining Unit(s) wish to be represented by the intervening Employee Organization, and (4) that it wishes to be included on the secret ballot. If another Employee Organization intervenes, FCCPS will post a new election notice.
If you have any questions, you should contact Keith Greenberg, the Labor Relations Neutral for this election, at ElectionNeutral@laborarbitration.com.
